Dear User, you are on the website https://logity.ua/ (hereinafter – the «Website»), which is owned and operated by «LANDSTAR AGENT UKRAINE» LIMITED LIABILITY COMPANY, registration number: 39691426, registered at the address: 61166, Ukraine, Kharkiv region, Kharkiv city, Nauki avenue 38, office 414 ((hereinafter — «Logity», «We» in different cases).
Please read these Terms of Use (далі – «Terms») carefully before starting to use the Website. If you do not agree with the Terms, please stop visiting and using the Website immediately.
1. USE OF THE WEBSITE
1.1. These Terms regulate the procedure for the User’s use of the Website, the User’s access to the Website’s functionality, as well as the User’s access to services on the Website, among which, in particular, may be: access to the Logity blog, the ability to contact Logity by filling out and submitting (sending) an application for a vacancy, through the feedback service or using any other method available on the Website, and using other services or technical capabilities available on the Website.
1.2. The User may use any services or functionality of the Website available on it, but in any case the User must not use the Website, any of its services and/or technical capabilities or functionality for any illegal purposes, and may not violate any laws or other regulatory acts of Ukraine and other countries (jurisdictions) that apply to the User (including, but not limited to, legislation on copyright and related rights), as well as international treaties and agreements, EU Regulations and others regional or international entities that apply to the User in each specific case and/or that operate on the territory of Ukraine.
1.3. Before using the Website, the User must familiarize themselves with these Terms and adhere to them. The use of the Website without prior review and acceptance of the Terms is prohibited.
1.4. User’s agreement with the Terms is also considered to be any conclusive actions aimed at using the Website, its services, or functionality, including but not limited to:
1.4.1. Continuing to use and not leaving the Website after reviewing the Terms.
1.4.2. transition to any web pages, hyperlinks to the Website;
1.4.3. using the “Apply” widget on the Website and entering any personal data in the Application form;
1.4.4. any other interaction with the Website.

2.1.3. online form for applying for vacancies, list of vacancies;
2.1.4. Logity blog;
2.1.5. contact information, feedback methods;
2.1.6. hyperlinks to third-party services;
2.1.7. any other information that Logity chooses to post on the Website.
3. CHANGES TO THE WEBSITE AND TO THE TERMS
3.1. Logity reserves the right, temporarily or permanently, to modify, suspend or completely terminate the operation of the Website (or any part thereof, functionality or relevant content) without prior notice to the User or third parties, at its sole discretion, at any time and from any – what reason.
3.2. Logity may from time to time, at its sole discretion, for any reason, without notice and without any liability to Users or any other person, modify, supplement or amend these Terms, herewith the User’s continued use of the Website and/or any service or functionality of the Website is deemed to be the User’s agreement to the additional terms and conditions (hereinafter referred to as the “Revised Terms”) in order to continue using the Website.
3.3. We may from time to time restrict access to the Website for maintenance and updates at Our sole discretion.
3.4. Logity may independently and at its own discretion grant certain categories of Users or certain Users (for example, Candidates (within the meaning of the Policy)) access to some parts or functionality of the Website, and not grant such access to other Users or categories of Users and/or limit the access of certain categories of Users or Users to individual parts and/or services and/or functionality of the Website). Logity reserves the right for any reason at Logity’s discretion to withdraw and/or change such features of access to certain parts of the Website and/or services and/or functionality for certain categories of Users or Users.
3.5. In the event of a change to the Terms, in order to access certain sections of the Website, use certain functions, web pages, the User must accept the Revised Terms. If the User continues to use the Website and/or its individual parts, services or technical capabilities after Logity has made changes to these Terms, it is considered that the User has properly familiarized himself with such changes and the new version of the Terms (read the Revised Terms), fully and unconditionally accepted and agree to use the Website in compliance with the new Terms (Revised Terms).
3.6. The User agrees that he undertakes the obligation and is responsible for tracking changes on Our Website (including changes to these Terms). We do Our best to publish any new information about changes in the Terms, but the User should check the Terms independently each time when going to the Website for updates and/or changes and/or new Terms. In any case, the User is obliged to comply with changes to these Terms and Conditions from the moment they are entered and published (posted) on the Website.
3.7. We are not liable to the User or any third party for any modification, suspension or termination of the Website or its content or functionality.
3.8. We are not responsible for interruptions in access to the Website caused by failures in the operation of servers, routers, networks, etc. of third-party data centers or Internet providers (Providers) of the User or a specific Provider chosen by the User, or communication problems caused by them.
4. INTELLECTUAL PROPERTY
4.1. Any literary and artistic works and any posted information that has the characteristics of a work (in particular, but not exclusively, on the “Blog” webpage), computer programs (in particular, but not exclusively, the code of the Website), databases, other works within the meaning of the Civil Code of Ukraine and the Law of Ukraine “On Copyright and Related Rights”, other functions, functionality (including, but not limited to, all information, text, images, video, audio, as well as their design, selection and location ), materials, processes, procedures, methods, techniques, trademarks and any other content, as well as any objects under applicable law (“Intellectual Property”) are owned by Logity, or are used by Logity in a lawful manner grounds All rights reserved.
4.2. Any unauthorized, improper use of the Website or its content contrary to the Terms, copying of works, including, but not limited to, the Website code, Website design, articles, video content and videos themselves, is prohibited. The use of videograms and articles posted on the Website or third-party sites is permitted only with a link to the Logity site or the site of third parties that legitimately use such Logity materials.
4.3. The User acknowledges, understands and agrees that Logity retains all rights to the Intellectual Property, except for personal data, which is subject to the Privacy Policy.
4.4. Unauthorized use of any trademarks (marks for goods and services), including reproduction, imitation, misleading use, is prohibited in accordance with these Terms and the Law of Ukraine “On the Protection of Rights to Marks for Goods and Services”, as well as other legislation of Ukraine and other countries, international treaties and agreements, if applicable in each specific case.
4.5. If the User violates the requirements of these Terms, he may be immediately terminated from accessing the Website, and he will also be liable in accordance with the legislation of Ukraine.
4.6. The User is not granted any right to use Logity’s Intellectual Property objects, except as expressly established in other provisions of these Terms and/or in separate agreements with Logity. If the User wishes to use any material for other purposes or in another way not provided for in these Terms, such use is possible only with the prior written permission of Logity at the User’s request sent by mail hr@logity.ua.
5. PRIVACY POLICY
5.1. Logity does not collect personal data of Users, except for those expressly stated in the Privacy Policy. Logity reserves the right to make changes to the Privacy Policy, so you can familiarize yourself with the current version at the link: https://logity.ua/en/privacy_policy/.
6. CONFIDENTIAL INFORMATION OF LOGITY
6.1. Confidential is information that is in the possession, use and disposal of Logity and access to which is restricted by Logity.
6.2. Confidential information includes any information related to Logity’s activities, including information classified as Logity’s commercial secret, with the exception of information that cannot be classified as a commercial secret or confidential information according to the legislation of Ukraine.
6.3. In addition, any information posted on the Website, access to which is not provided by Logity for all users, i.e. access is provided only for certain users or for certain categories of users (for example, for Candidates (in the sense of the Policy)) is also confidential.
6.4. Disclosure of Logity’s сonfidential Information without Logity’s prior written consent is prohibited. Disclosure of information is considered to be any action or inaction of the User, which directly or indirectly led to the fact that such information became known to at least one third person.
6.5. In the case of disclosure without the prior written consent of Logity of information constituting Logity’s confidential information, the User may be held criminally, administratively or otherwise liable in accordance with the legislation of Ukraine, and is also obliged to compensate Logity for the damage caused in full, including lost profit and damage to business the reputation of Logity and others who will be so harmed.
6.6. Upon termination of use of the Website, the User shall immediately delete all information constituting Logity’s confidential information, which became known to him in connection with the use of the Website and/or its services or functionality. In addition, regardless of the above and regardless of the continuation or non-continuation of the use of the Website, such deletion of information must be carried out by the User immediately and at the first request of Logity.

8.5. LOGITY DOES NOT PERFORM PERSONAL VERIFICATION AND/OR DOES NOT PERFORM USER IDENTITY VERIFICATION AND IS NOT RESPONSIBLE FOR ANY CONSEQUENCES OF FAILURE TO PERFORM SUCH VERIFICATION.
8.6. LOGITY IS NOT RESPONSIBLE FOR ANY INFORMATION UPLOADED TO THE WEBSITE (IN APPLICATION, RESUME, OR OTHERWISE) BY AND/OR ABOUT USERS. ALSO, LOGITY DOES NOT WARRANT THE ACCURACY, SUITABILITY, OR RESPONSE OF LOGITY TO YOUR APPLICATION AND/OR RESUME AND/OR APPLICATION OR USER LETTER.
8.7. LOGITY IS NOT RESPONSIBLE FOR THE USER’S USE OF THIRD-PARTY SERVICES.
8.8. NOR DOES LOGITY WARRANT THAT:
8.8.1. THE SERVICES AND/OR OTHER WEBSITE FUNCTIONS WILL BE COMPATIBLE WITH YOUR COMPUTER AND RELATED HARDWARE AND/OR SOFTWARE;
8.8.2. THE SERVICES AND/OR OTHER WEBSITE FUNCTIONS WILL BE AVAILABLE OR OPERATING UNINTERRUPTED OR ERROR-FREE OR ANY ERRORS WILL BE CORRECTED;
8.8.3. INFORMATION AVAILABLE ON OR THROUGH THE SERVICES AND/OR THROUGH OTHER WEBSITE FEATURES WILL BE ACCURATE, COMPLETE, SEQUENTIAL OR TIMELY;
8.8.4. THE INFORMATION ON THE WEBSITE WILL NOT INFRINGE THE RIGHTS OF THIRD PARTIES;

8.9. The User agrees to use the Logity Website with all reasonable security measures and not to rely solely on Logity to maintain the resume or other information of and/or about the User.
8.10. The User understands that any website may be subject to virus attacks, distortion of information, other cases independent of Logity.
8.11. The User voluntarily waives any claims against Logity, as well as the filing of lawsuits regarding the use of the Website. The User will not claim compensation for any damages in connection with the use of the Website or its individual parts and/or functionality and/or information from the Website.
9. NORMS OF CONDUCT
9.1. The User is solely responsible for all actions he takes on the Website and agrees to use the Website in accordance with these Terms, and also not to provide Logity with the following information:
9.1.1. false, inaccurate, or otherwise misleading, harmful, illegal, threatening, abusive, defamatory, obscene, or that constitutes or encourages a criminal and/or administrative offense, would give rise to civil liability, or violate applicable laws, regulations and/or or provisions;
9.1.2. that infringes the property rights of others, including, without limitation, copyright, trademark (goods and services mark), industrial design, patent, trade secret and/or confidential information and/or information or material that infringes the rights of others individuals on private life and confidentiality, other information protected by law;
9.1.3. any promotional materials without Logity’s prior written consent, including any unsolicited mail, spam, fraudulent emails or any other similar solicitation;
9.2. The User is obliged to use the Website in accordance with its purpose, namely to familiarize with the materials posted on the Website and/or to submit a Job Application, as well as to use other services or functionality available on the Website. Any other illegal, unauthorized use of the Website is a violation of the Terms and such a User will bear responsibility in accordance with the legislation of Ukraine.
9.3. The User, in particular, undertakes not to do the following:
9.3.1. violate these Terms or applicable law;
9.3.2. fraudulent actions;
9.3.3. damage any web pages of the Website, make changes to any materials of the Website, take other actions aimed at unauthorized access to the Website or the Website code;
9.3.4. violate the copyrights or any intellectual property rights (including, without limitation, copyrights, trademarks and broadcasting rights) or privacy rights or other rights of Logity or any third party;
9.3.5. create derivative versions of any information or materials. Create copies of the Website, use the Website code, perform other actions with the Website code or other services posted on the Website;
9.3.6. impersonate another person;
9.3.7. use bots, bypass security programs, overload the site, carry out attacks on the Website, commit other actions that may be considered cybercrimes, limit or prevent any other user from using the Website;
9.3.8. interfere in any other way with the normal operation of the services and use programs that may be designed to damage, maliciously interfere, secretly intercept or expropriate any system, data or personal information;
9.3.9. actions contrary to any specific rule or requirement that We establish on the Website in relation to a certain part of the Website.
10. TERMINATION OF ACCESS TO THE WEBSITE
10.1. Logity has the right at any time, at its own discretion, to terminate the User’s access to the Website on its own initiative, without the application of penalties to Logity or the liability of Logity to the User or to any third party, as well as in the event that the User violates the Terms or commits any any other actions that may lead to a violation of the Terms.
11. In the event of a breach by the User of these Terms, this action is in addition to, and not in lieu of, any other right or remedy that may be available to Us. The following sections of these Terms remain valid and binding for the User indefinitely after termination of these Terms and/or termination of use of the Website by the User for any reason: Intellectual Property, Limitation of Liability, Applicable Law and Dispute Resolution.
12. APPLICABLE LAW AND DISPUTE RESOLUTION
12.1. Terms of use of the Logity website are regulated by the legislation of Ukraine. Logity and the User also have other rights that are not expressly provided for in the Terms, but which are contained in the legislation of Ukraine.
12.2. Any disputes should be resolved by contacting the feedback service by the Users at hr@logity.ua.
12.3. In the event of failure to reach an agreement, dispute resolution should take place according to the procedure established by the legislation of Ukraine.
12.4. If any of the provisions of these Terms are found by a court of Ukraine or a court of other competent jurisdiction to be unenforceable, then such provisions shall be modified, limited or repealed only to the minimum extent necessary to keep these Terms in full force and effect.
